GPC Decision No293 For 2006 Regarding Establishing General Organization For Communications

Article (1)

General organization of communications” is to be established according to this decision. It will have its own important personality and independent financial status and will be supervised by GPC.

 

Article (2)

The main headquarters will be in Tripoli, however there maybe branches or offices around the country as will be decided by the organization.

 

Article (3)

The organization will follow up services and activities of both posts, communications and telecommunications, it is also responsible towards communication nets, systems and satellite services, and execute projects within its regulations, the following are some of its tasks:

-To suggest law drafts and rules concerning satellite, post services and communication sector

-To execute legislations related to satellite, communications, telecommunications, post services and activities.

-To set national plans for communications and to control its execution.

-To suggest rules for granting communications and telecommunications licenses.

-To supervise and control activities of post, communications and telecommunications and follow up of companies working in this field

-To encourage investment in post and communications sector and to offered facilities for that.

-To set technical and standard specifications for communications and telecommunications systems to all authorities of the state.

-To supervise satellite projects and to execute related legislations.

-To study international agreements and treaties related to post and communications, to propose participation and to follow up their execution.

-To present Libyan state in international organizations related to work field of the organization, which should be arranged with the specialized authorities.

-To participate in international organizations and to attend international and regional conferences with connection to its work field, then to submit its decisions and recommendations to be approved and executed by concerned authorities.

-To determine uneconomic standards and regulations of communication services in developing regions and to determine the obligations of operators and service suppliers

-To determine standards and regulations concerning national security in the post, communications and telecommunications sector with the coordination of concerned authorities.

-To allocate prices and costs of offered services and follow up its execution

-To determine the minimum limits of quality and service levels that must be offered by operators and service suppliers

-To organize connection between communication nets of different existing authorities which render services.

-To develop national plan of frequent spectrum, and to manage and develop use of frequency in communication services.

-To take legal arrangements concerning offences in post and communication services field.

-To issue and determine charges of different types of licenses, and to grant approvals regarding activity of post services, communications and telecommunications, control and follow up record of licensees, and to amend or cancel the licenses according to organizing legislations. This should be within rules of executive legislation of amended law No.(21) for 2001 regarding some rules to practice economic activities.

–  To revise and evaluate need to modify any service of posts and communication and to suggest the necessary solutions.

–  To encourage competition in field of post and communication services, and to prohibit uncompetitive behavior.

–  To collect information concerning posts and communication sector, and to prepare and issue reports and leaflets to guide service users, and to contribute in prepare information programs for use of the public service in this field.

 

 

Article (4)

The organization has to act the following in order to achieve its purposes:

–  To own real estate necessary for performance of its duties.

–  To establish companies or joint stock companies.

–  To prepare conferences and training courses in and out of Libya .

–  To get assistance from experts in the country and from abroad.

 

Article (5)

The organization will offer advice and technical services to the public authorities in its field of specialty, as well as to offer services for other authorities and in this case it will be paid for the offered services, the value will be determined by a decision from the people’s committee of the organization.

 

Article (6)

The organization is managed by people’s committee, it will be managed by administrative committee according a decision from GPC until the committee is formed.

 

Article (7)

Secretary of people’s committee of the organization has large authorities to run affairs, and he has to:

–  To execute plans and general programs of the organization, coordinate the works and to control that.

–  To run the official affairs of the staff according to legal legislation.

–  To prepare the budgets and final account of the organization which will submitted for approval by people’s committee.

–  Suggest loans contracts to finance the activities of the organization.

–  Prepare periodical reports about the organization activities.

–  To represent the organization in the relations with others including courts, and signing of contracts.

–  To attend meetings with superior people’s committees with relation to the organization work field.

 

Article (8)

The organization will have its own independent budget which is to be prepared according to the normal account regulations; the financial year begins and ends as on the same dates of the state’s financial year. The first financial year starts when this decision comes into effect, the end will be at the end of this financial year.

 

Article (9) financial resources of the organization are:

-Allocation from general budget of the state.

–  What it gets from the services and revenues.

–  Unconditioned donations and assistances that the people’s committee accept.

 

Article (10)

One or more bank account is to be opened in one of working banks in Libya where the earnings will be deposited.

 

Article (11)

There will be a number of administrations and offices whose functions will be approved by the GPC of labor, training and employment.

 

Article (12)

Workers who will be named by GPC will have (judicial control authority), which connects with the work of the organization, and control the crimes perpetrated against legislative rules of the work.

 

Article (13)

The following companies are supervised by the organization:

1- Libyan holding company for post, communication and information technology and what is included according to the following:

-General company for post and telecommunication.

–  Madar for telecommunications company.

–  Libyana for mobile telephone company.

–  Libya for communication and technology company.

2- Libyan joint stock company for communication. The permanent committee of granting licenses for wireless apparatuses and frequencies.

Article (14)

Workers in field of communications in GPC transport communication to be moved to the organization in coordination between secretary of GPC of transportation and communication and secretary of people’s committee of the organization as needed.

Article (15)

The financial auditing authority will legally revise and check the accounts of the organization.

This decision to be applied from date of its issue, to cancel any rules contradicting the decision, and to be executed by concerned authorities.
